Terms & Conditions
§ 1 Area of Application
The following general terms and conditions apply exclusively to the business relationship between WVT Wissenschaftlichen Verlag Trier and the customer. WVT does not recognize deviating conditions of the customer unless WVT has expressly agreed to their validity in writing.
These Terms & Conditions are valid only in their German language version. The English language version of these Terms & Conditions is not legally binding and only serves information purposes.
§ 2 Conclusion of Contract and Right of Withdrawal (according to Art. 246a § 1 Section 2 No. 1 EGBGB)
By sending his order, the customer submits an offer to conclude a contract. After placing the order, the customer receives an automated order confirmation. This order confirmation does not yet represent acceptance of the contract. The contract is accepted either by WVT confirming acceptance of your order and thus the conclusion of the contract and the dispatch of the article in a further e-mail, or by sending the ordered goods.
The customer can cancel the order within 14 days (by e-mail, letter or fax) or return the goods. The period begins at the latest on the day on which the customer receives the goods.
It is pointed out that WVT can withhold a reduction in value caused by improperly packaged returns or by the use of the item.
Due to the nature of the goods, there is no right of withdrawal for data that is produced and provided in digital form (§ 312f Para. 3 BGB) but is not stored on a physical data carrier (§ 356 Para. 5 BGB) (e.g. e-books). When purchasing these digital goods that are not stored on a physical data carrier, the customer expressly agrees, by clicking on an opt-in box, that the seller may start performing the contract before the end of the expiry of the cancellation period and that the consumer waives his right of withdrawal with this start of the execution of the contract.
The WVT does not offer any products for sale by minors.
§ 3 Delivery
Unless otherwise agreed, delivery will be made from stock to the delivery address specified by the customer. Information about the delivery period is non-binding, unless there has been a binding assurance concerning the delivery date.
§ 4 Maturity and Payment, Default
The customer receives an invoice and pays for the goods plus shipping costs by bank transfer, Paypal, Master Card or Visa Card.
If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract and agrees that the goods will only be dispatched after receipt of payment.
If the customer is in default of payment, WVT is entitled to demand interest on arrears at a rate of 5% above the base interest rate p.a. announced by the European Central Bank. If WVT can prove that the damage caused by the delay was higher, the publisher is entitled to assert this.
§ 5 Digital Products
With the conclusion of the contract, the costumer acquires the non-exclusive, non-transferable, spatially and temporally unrestricted right to use the digital content for private use only. Disclosure to third parties and commercial use are not permitted. Copyright notices and watermarks may not be removed. The buyer is not entitled to change the content, edit it or make it available for download.

Our e-books are available as pdf files. The files can be used on all devices that can display pdf files.
Open Access publications are freely accessible - without time restrictions, without further technical requirements and without costs for the end user. Our Open Access publications are released under a 'Creative Commons' license ('CC BY-NC-ND', version 4.0, see creativecommons.org/licenses/by-nc-nd/4.0/deed). The author's copyrights remain protected. Users are obliged to name copyright and rights holders. Users are prohibited from using the publication for commercial purposes.
§ 6 Offsetting, Retention
The customer is only entitled to set-off if his counterclaims have been legally established or recognized by WVT. In addition, he is only authorized to exercise a right of retention insofar as his counterclaim is based on the same contractual relationship.
§ 7 Reservation of Title
The delivered goods remain the property of the WVT until full payment has been made.
§ 8 Liability for Defects
If there is a defect in the purchased item, the customer can request subsequent performance (remedy of the defect or replacement delivery). If the supplementary performance fails, the customer can withdraw from the contract, reduce the purchase price or claim damages if the defect is not insignificant.
Unless otherwise stated below, further claims of the customer - regardless of the legal grounds - are excluded. The WVT is therefore not liable for damage that has not occurred to the delivery item itself; in particular, the publisher is not liable for lost profits or other financial losses suffered by the customer. Insofar as liability is excluded or limited by WVT, this also applies to the personal liability of employees, representatives and vicarious agents.
The above limitation of liability does not apply if the damage was caused intentionally or through gross negligence or if there was personal injury. Furthermore, it does not apply if the customer asserts claims under Sections 1 and 4 of the Product Liability Act (Produkthaftungsgesetz).
If WVT negligently violates a contractual obligation, the obligation to compensate for property damage is limited to the damage that typically occurs.
The limitation period is twenty-four months from delivery.
§ 9 Privacy Policy
You can visit our website without providing any information about yourself. We use the information you enter to process orders, deliver goods and provide services, and process payments. We will not share your information with third parties. Persons under the age of 18 should not transmit any personal data to us without the consent of their parents or legal guardians. We do not solicit, collect or share personal information from children.
Our online offer contains links to other websites. We have no influence on whether their operators comply with data protection regulations.
§ 10 Disclaimer
Despite careful content control, we assume no liability for the content of external links. The operators of the linked pages are solely responsible for their content.
§ 11 Applicable Law
All legal relationships governed by these Terms & Conditions are subject to the law of the Federal Republic of Germany with the exception of the United Nations Convention on contracts for the International Sale of Goods and any other regulation that would lead to the application of any foreign law.
